Section 337 litigation at the U.S. International Trade Commission has become more prevalent in recent years due to the speed of the proceedings and the availability of injunctive relief barring entry of infringing products to the U.S. market.  Companies need to understand how to defend their products and U.S. market share when they are named as a respondent in a Section 337 action, as well as how they can effectively utilize the ITC as a complainant.  This seminar provides an overview of Section 337 litigation and explores some of the practical aspects of litigating at the ITC that every company should know.

Joseph V. Colaianni is a principal in the Washington, D.C., office of Fish & Richardson P.C. Mr. Colaianni’s practice has a particular focus on litigating high-stakes patent infringement actions in U.S. district courts and the U.S. International Trade Commission (ITC). Mr. Colaianni also represents clients in IPR proceedings before the U.S. Patent and Trademark Office and regularly represents clients based in China, Taiwan, Korea and the United States.

Prior to joining Fish & Richardson, Mr. Colaianni served as a patent examiner at the U.S. Patent and Trademark Office, examining patent applications relating to electronic imaging devices, including charge coupled devices and digital camera technology.

Mr. Colaianni was selected for inclusion as a “leading patent practitioner” in the 2013-2014 and 2016-2020 editions of IAM Patent 1000 for national patent prosecution and litigation practices. In the 2020 edition of IAM Patent 1000, Mr. Colaianni was recognized as a leading attorney at the ITC. He was also selected for inclusion in the 2021 “Best Lawyers in America” list by The Best Lawyers in America©.

Linhong Zhang is an IP litigator who focuses his practice on developing and executing litigation strategies in complex, high-stakes, and multi-jurisdictional IP disputes in U.S. district courts, the Federal Circuit, the International Trade Commission (ITC), and the Patent Trial and Appeal Board (PTAB). He has practiced extensively in the ITC, representing both complainants and respondents in numerous technically complex matters, and is routinely sought out for his insights into ITC law and practice. Linhong is also regularly consulted on settlement and licensing matters. His practice also encompasses post-grant proceedings at the PTAB, particularly where post-grant matters must be coordinated with co-pending litigation.
